Authorities report that the tree was situated on a vacant parcel owned by Harmony Communities, a Stockton-based company. In 2017, the company had received city approval for a project that mandated the preservation of the heritage oak while developing mobile home spaces around it. However, no further actions were taken until the recent tree removal.

The city’s Tree Ordinance explicitly prohibits the removal of heritage oak trees on undeveloped land, making this incident a potential violation. Public Information Officer Spencer Bowen clarified that any removal requires compliance with city regulations, including a tree preservation plan and monetary compensation for removed trees.

Wilkinson revealed that the property owner claimed the city lacked jurisdiction over the parcel, leading to the unauthorized removal. Alarmingly, the property owner hired an arborist to evaluate the tree’s health, but the report was submitted only after the tree was cut down. Wilkinson criticized the findings as “thin and inconclusive,” suggesting that the tree likely only required maintenance.

In response to the violation, the city has fined the property owner approximately $8,000. However, the owner is contesting the fine, and legal representatives are currently involved in the case. Bowen indicated that the city cannot provide further comments due to the ongoing investigation and appeal process.
