Major Retailers Violate Maine’s PFAS Law, Watchdog Reports Urgent Update

UPDATE: A Maine-based watchdog group has just revealed that major retailers are violating the state’s strict ban on products containing toxic “forever chemicals.” The ban, which was extended on January 1, 2023, now includes consumer products with intentionally added per- and polyfluoroalkyl substances, or PFAS, covering items such as cookware, cosmetics, and upholstered furniture.

Emily Carey Perez de Alejo, executive director of Defend Our Health, stated that the group immediately identified banned nonstick pans available online from retailers including Walmart, Target, and Wayfair. “We have seen, unfortunately, some online retailers who have not yet complied with Maine’s law,” she said. “They may not be aware, or they may think that Maine is small enough that they can ignore us, which is not true.”

This urgent issue highlights the potential health risks associated with PFAS, chemicals linked to serious medical conditions like immune disorders and cancer. The group’s initial search for violations is not exhaustive, but Perez de Alejo confirmed they intend to broaden their monitoring efforts to ensure compliance among retailers.

Many products containing PFAS have already been removed from store shelves across Maine, yet these online violations raise concerns. “We just want to give everybody a chance to come into full compliance so that shoppers don’t have to be thinking about this,” Perez de Alejo explained. “I don’t want to have to know whether the pan that I’m buying has PFAS in it or not. I just want that not to be available for sale, so it’s not a thing I have to worry about.”

PFAS are notoriously durable chemicals that do not break down in the environment, earning them the moniker “forever chemicals.” As their harmful effects come to light, the pressure mounts on retailers to adhere to state regulations.

Defend Our Health has reported these violations to the Maine Department of Environmental Protection. Kerri Farris, the department’s safer chemicals program manager, confirmed that officials will reach out to the companies involved and mandate compliance with the law.

As of now, Walmart, Target, and Wayfair have not responded to requests for comments regarding these potential violations. This developing story underscores the ongoing battle for consumer safety in Maine and calls for immediate action from both retailers and regulators.
