Jack Smith Subpoenaed by Congress for Trump Investigations

Former Special Counsel Jack Smith has been subpoenaed to testify regarding his investigations into former President Donald Trump. This development, announced by Jim Jordan, Chairman of the House Judiciary Committee, requires Smith to appear for a deposition on December 17, 2025, at 10 a.m. Jordan has also requested all documents and communications from Smith’s time as Special Counsel.

In a letter dated December 3, Jordan outlined the Committee’s ongoing oversight of the Office of Special Counsel, emphasizing that Smith possesses crucial information related to the prosecutions of Trump and his co-defendants. The letter states, “Due to your service as Special Counsel, the Committee believes that you possess information that is vital to its oversight of this matter.”

Jordan’s request for a deposition comes as Republican lawmakers ramp up their criticisms of Smith’s investigations, particularly those concerning the 2020 election. They argue that the inquiries have overstepped boundaries and implicated various GOP officials, Trump allies, and media outlets.

In August 2023, Smith charged Trump with conspiring to overturn the results of the 2020 presidential election following his defeat to Joe Biden. Prosecutors accused Trump and his associates of promoting false claims of election fraud to pressure state officials into invalidating Biden’s win. They also alleged that Trump sought to influence then-Vice President Mike Pence into disrupting the ceremonial counting of electoral votes on January 6, 2021, the day of the Capitol riot.

Following Trump’s reelection in 2024, Smith moved to drop this case. In a separate matter, he charged Trump in June 2023 with unlawfully retaining classified documents taken from the White House. After leaving office in January 2021, Trump allegedly obstructed government requests for the return of these documents. Additional charges emerged in July 2023, accusing Trump of displaying a Pentagon “plan of attack” to guests at his golf club in New Jersey.

Smith ultimately decided to drop this case as well after Trump’s election victory.

This subpoena from Congress highlights the ongoing political and legal battles surrounding Trump and his associates. As the situation develops, it underscores the complex intersection of politics, law, and governance in the United States.
